SSO Position on Proposed Changes to the Not Criminally Responsible (NCR) Provision under Bill C-54

On February 8, 2013, the Government of Canada tabled a Bill (C-54) proposing changes to the Not Criminally Responsible on account of Mental Disorder (NCR) provision under the Criminal Code of Canada. This Bill specifies that the safety of the public is of the utmost importance in the decision-making for the cases involving individuals who have been found NCR The Bill creates a designation of “high risk” for some accused and proposes that annual reviews for “high risk” individuals are to be changed from happening annually to happening every three years.
